How Speculator collects, uses, shares, and retains personal information when merchants install and use the app with Shopify.

1. Definitions

For the purposes of this Privacy Policy:

  • "App" means Speculator.
  • "Service" means the prescription lenses checkout and fulfilment functionality and any related features provided by the App.
  • "Merchant", "you", and "your" mean the Shopify merchant or store owner that installs or uses the App.
  • "Customer" means an end customer of a Merchant's Shopify store.
  • "Shopify" means the Shopify platform and related services.
  • "Personal Information" means information that identifies, relates to, describes, or can reasonably be linked to an identified or identifiable person.
  • "Site" means our website and any online services through which we provide information about the App or Service.

2. Scope

This Privacy Policy explains how we collect, use, disclose, and retain Personal Information when you install, access, or use the App in connection with your Shopify-supported store.

3. Personal Information We Collect

3.1 Information we access from Shopify

When you install the App, we automatically access certain information from your Shopify account through the following API scopes:

  • read_products and write_products Used to create and maintain linked lens products and variants based on your lens configurations in the App.

  • read_orders Used to show a merchant-facing view of Speculator-related orders and, where prescription details are still outstanding, read the Shopify order email address so the merchant can follow up with the customer.

  • write_app_proxy Used to serve the storefront selection flow through Shopify's app proxy.

3.2 Information you provide directly

We may collect Personal Information directly from you or from individuals who access the App on behalf of your store, including:

  • Name(s)
  • Address(es)
  • e-Mail address(es)
  • Phone Number(s)
  • Billing Information
  • Prescription Eyewear Information
  • Any other information you choose to provide when using the App or contacting us

3.3 Information relating to your customers

To provide the Service, we may collect and process certain Customer information made available through Shopify or submitted through your store, including:

  • Customer email address and Shopify order identifier associated with a Speculator-related order
  • Manual prescription values submitted for an order, including optical prescription and pupillary-distance measurements
  • Prescription follow-up indicators and custom lens selections attached to the order
  • Other eyewear-related order details needed to support fulfilment

3.4 Information collected automatically

We and our service providers may collect certain information automatically through the App or Site using technologies such as:

  • Cookies Data files placed on a device or computer, often including an anonymous unique identifier.

  • Log files Records that may include IP address, browser type, internet service provider, referring and exit pages, and date and time stamps.

  • Web beacons, tags, and pixels Electronic technologies used to record information about browsing, usage, and interactions.

4. How We Use Personal Information

We use Personal Information to provide, operate, maintain, and improve the App and the Service, including to:

  • deliver prescription eyewear checkout and fulfilment features
  • create, update, and manage lens-related products and order data
  • let merchants review Speculator-related orders and contact customers who still need to provide prescription details
  • communicate with you about your account, support, updates, and service-related matters
  • optimize, troubleshoot, secure, and improve the App
  • maintain records and internal business operations
  • provide information, marketing, or advertising relating to our products or services, where permitted by applicable law
  • comply with legal obligations and enforce our rights

5. How We Share Personal Information

We may share Personal Information with third parties in the following circumstances:

  • Service providers and vendors who help us operate the App, host infrastructure, process data, provide support, or fulfil orders
  • Fulfilment partners where needed to provide prescription eyewear or related services
  • Professional advisers such as legal, accounting, or insurance advisers where necessary
  • Law enforcement, regulators, or other parties where required to comply with applicable law, regulation, subpoena, search warrant, or other lawful request
  • Other parties where necessary to protect our rights, property, safety, users, or the public

We do not sell Personal Information unless expressly stated otherwise.

If you are located in the European Economic Area or the United Kingdom, we generally process Personal Information where necessary to:

  • perform a contract with you
  • provide the Service you request
  • comply with legal obligations
  • pursue our legitimate business interests, provided those interests are not overridden by your rights and freedoms

7. International Transfers

Personal Information may be transferred to and processed in countries outside your jurisdiction, including outside Europe, such as Canada and the United States. Where required by law, we take appropriate steps to protect Personal Information transferred internationally.

8. Data Retention

We retain Personal Information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

Speculator reads order information from Shopify as needed for merchant order review and prescription follow-up workflows. When manual prescription details are submitted for a Speculator-related order, Speculator stores those details in Google Cloud Firestore with the customer's email address and Shopify order identifier so the Merchant can securely review and fulfil the order.

For Shopify's mandatory compliance webhooks:

  • customer data access requests identify matching stored prescription records by customer email address and Shopify order identifier; notification emails include only record counts and order identifiers, never prescription values
  • customer redaction requests delete prescription records matching the customer email address or Shopify order identifiers supplied by Shopify
  • shop redaction requests trigger deletion of Speculator-hosted per-shop data within the Shopify compliance window, including sessions, billing records, cached contacts, configuration, prescription details, and store-scoped operational error records used by the App

9. Your Rights

Depending on your location, you may have rights in relation to your Personal Information, including the right to:

  • access the Personal Information we hold about you
  • request correction or updating of inaccurate information
  • request deletion of your information
  • object to or restrict certain processing
  • withdraw consent where processing is based on consent
  • lodge a complaint with a relevant supervisory authority

10. Cookies and Similar Technologies
